Our second webinar of the year is titled: EBR, Environmental Appeals, and Judicial Reviews – Understanding and Preparing for Public Participation. The webinar will take place on Thursday, March 2, 2023 from 12:00 pm to 1:00 pm via Zoom.

In this webinar, Richard Butler, Joanna Vince, and Giselle Davidian will explore a number of legal rights and tools available to the public through the Ontario Environmental Bill of Rights. These tools allow the public to participate in environmental decisions. This includes the requirement for meaningful notice and comment opportunities and to have comments duly considered by governmental decision-makers. We will review how industry participants and the public can navigate the public participation regime to protect their respective interests and existing operations. We will also discuss how industry and others applying for environmental approvals can prepare themselves for potential public participation – a potential lengthy and costly endeavour.

Finally, we will consider judicial reviews as another tool (in addition to appeals) that may be used to challenge environmental decisions. Our discussion will include considering the differences between environmental appeals and judicial reviews, standards of review in judicial reviews and available remedies.
